DELEGATION OF AUTHORITY AND RESPONSIBILITY
Major Responsibilities That Cannot Be Delegated:

accountability
for the implementation of a system or systems that effectively
manage conflict of interest activities |
| B. |
committing
the Administrative Official's area of responsibility
to using University resources solely for the benefit of the
University |
Major
Responsibilities That Can Be Delegated:
| A. |
establishing
departmental / unit policies and procedures which ensure that:
| 1. |
UCSC policies and codes regarding conflict of interest
are followed |
| 2. |
faculty
and staff employees are aware of disclosure and disqualification
requirements |

| B. |
monitoring,
preventing, and reducing possible conflict of interest situations |
AREAS OF POTENTIAL RISK
An employee who violates conflict of interest laws may be subject
to administrative, civil, and criminal penalties. A conflict of
interest situation could result from
| A. |
an
employee failing to fully disclose his/her financial interest
in a firm doing business with UCSC, which is a violation of
federal and state laws |
| B. |
an
employee failing to disclose a significant personal financial
interest related to a sponsored project for which the employee
is responsible for the design, conduct or reporting of, and
for which the financial interest might reasonably appear to
be directly and significantly affected by the sponsored project |
| C. |
a
Principal Investigator failing to disclose, prior to making
any commitment to accept funding, that he/she or a near relative
has a direct or indirect financial interest in the sponsor of
research funded in whole or in part through a gift, contract,
or grant from a non-governmental entity |
| D. |
a
faculty member or employee participating in or influencing a
campus business decision that could result in either personal
gain or advantage being given to a firm in which the near relative
of a faculty member or employee has a financial interest |
| E. |
a
faculty member or employee purchasing or leasing goods or services
from another University employee, near relative, or domestic
partner without the approval of the Materiel Management Director
who determines if the goods or services are unavailable from
commercial sources or the University's own facilities |
| F. |
a
faculty member or employee not discussing a potential conflict
of interest situation with an Administrative Official or other UCSC official, such as the Conflict of Interest Coordinator
or the Materiel Management Director |
| G. |
an
employee, who makes business decisions related to vendors or
other parties, accepting a gift from a vendor or other party |
